End User License Agreement (EULA)

1. This agreement

This license (EULA) is concluded between you and ⚠️ controller identification not yet published — missing, required by Article 13 GDPR ("we"), and covers the IDarU app for iOS and Android and its associated software. It is not concluded with Apple or Google.

The EULA complements the Terms of Service — conduct rules, content and moderation live there. If there is a conflict about the software license, this page prevails.

2. The license we grant you

We grant you a limited, personal, non-exclusive, non-transferable and revocable license to install and use the app on devices you own or control, for personal, non-commercial use, in accordance with the rules of the store you downloaded it from.

It is a license, not a sale: you are not buying the software, you are buying the right to use it while this EULA is in force.

3. What is ours and what is yours

The software, the IDarU brand, the design, the icons, the trophies and the texts in the app are ours or our licensors’, and stay that way. This license gives you no rights over them beyond using the app.

Your content (challenges, logs, photos, messages, posts) stays yours, on the exact terms of section 6 of the Terms of Service: you grant us only a limited license to operate the service, which ends when you delete the content or your account.

4. What you may not do

You may not copy, modify or create derivative works of the app; reverse engineer, decompile or disassemble the software, except to the extent the law expressly allows it; sell, rent, sublicense or redistribute the app; access the service by automated means (bots, scraping); or circumvent the app’s technical or security limits — including message limits and the display of ads.

5. Apple (App Store)

If you downloaded the app from the App Store, you acknowledge that this EULA is concluded between you and us only, not with Apple — and that we, not Apple, are responsible for the app and its content. In that case, the license in section 2 is limited to Apple-branded devices you own or control, as permitted by the Usage Rules of the App Store terms.

Apple has no obligation whatsoever to furnish maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim by you or a third party relating to the app — including product liability claims, failure to conform to legal or regulatory requirements, consumer protection claims, and claims that the app infringes intellectual property rights.

You represent that you are not located in a country subject to a U.S. embargo or designated as supporting terrorism, and that you are not on any U.S. list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

6. Google (Play Store)

If you downloaded the app from the Play Store, the same applies to Google: this EULA is concluded between you and us only, Google is not a party to it and is not responsible for the app, its maintenance or any claims relating to it. Downloading and updating through the Play Store is also subject to the Google Play Terms of Service.

7. Termination

This license ends automatically if you violate the EULA or the Terms of Service — for serious violations, without warning, as described in section 12 of the Terms. It also ends when you delete your account or uninstall the app.

When the license ends, you may no longer use the app. The sections on ownership, warranties, liability and governing law survive termination.

8. Warranties and liability

IDarU is provided "as is", as the Terms of Service say. To the maximum extent permitted by law, we give no warranties beyond those the law imposes and are not liable for indirect damages arising from use of the app, nor for content created by other users. Nothing in this EULA limits rights you have as a consumer under applicable law.

9. Governing law and forum

Portuguese law applies, as in the Terms of Service. Disputes arising from this EULA go to the courts of Lisbon, without prejudice to mandatory rules that, as a consumer, give you another forum. Contact: legal@idaru.app.
